Microsoft Corp, under fire for accessing an employee’s private Hotmail account to prove he was illegally passing computer code to a blogger, has said it will now refer all suspicious activity on its email services to law enforcement.

The decision, announced by head lawyer Brad Smith on Friday, reverses Microsoft’s initial reaction to complaints last week, when it laid out a plan to refer such cases to an unidentified former federal judge, and proceed to open a suspect email account only if that person saw evidence to justify it.

“Effective immediately, if we receive information indicating that someone is using our services to traffic in stolen intellectual or physical property from Microsoft, we will not inspect a customer’s private content ourselves,” said Smith, in a blog post on the software company’s website. “Instead, we will refer the matter to law enforcement if further action is required.”

Microsoft – which has recently cast itself as a defender of customer privacy – was harshly criticized last week by civil liberties groups after court documents made public in the prosecution of Alex Kibkalo in Seattle federal court for leaking trade secrets showed that Microsoft had accessed the defendant’s email account before taking the matter to legal authorities.

The company said last week its actions were within its legal rights under the terms of use of its email services, but has now acknowledged that its actions raised concerns about customer privacy.

The issue is poignant for Microsoft, which routinely criticizes Google Inc for serving up ads based on the content of users’ Gmail correspondence.

It has also been campaigning for more transparency in the legal process through which U.S. intelligence agencies can get access to email accounts following the revelations of former National Security Agency contractor Edward Snowden.

“While our own search was clearly within our legal rights, it seems apparent that we should apply a similar principle and rely on formal legal processes for our own investigations involving people who we suspect are stealing from us,” said Smith in his blog. “Therefore, rather than inspect the private content of customers ourselves in these instances, we should turn to law enforcement and their legal procedures.”

Virtru has added Microsoft’s Office 365 and Outlook Desktop services to its growing list of compatible email platforms available on its encryption product.

The company, headquartered in Washington, D.C. and launched in January, is targeting people using major email providers who want stronger privacy controls for more secure communication.

The service is designed to be easy to use for end users who may not have the technical gumption to set up PGP (Pretty Good Privacy), a standard for signing and encrypting content.

Virtru is compatible with most major webmail providers, including Google’s Gmail, Yahoo’s Mail and Microsoft’s Outlook webmail, which replaced Hotmail.

Emails sent using Virtru through those services would look like gibberish, providing a greater degree of privacy. Law enforcement or other entities would not be able to read the content unless they could obtain the key.

Virtru uses a browser extension to encrypt email on a person’s computer or mobile device. The content is decrypted after recipients receive a key, which is distributed by Virtru’s centralized key management server.

Although Virtru handles key management, the company is working on a product that would allow that task to be managed on-site for users, as some administrators would be uncomfortable with another entity managing their keys.

Virtru has said it put aside funds to contest government orders such as a National Security Letter or law enforcement request that are not based on a standard of probable cause.

Yahoo has ceased its efforts to keep documents related to Microsoft’s failed bid to buy the firm sealed.

Yahoo tried to keep documents relating to the failed 2008 buyout attempt by Microsoft sealed from investor Dan Loeb. Loeb, who runs the Third Point hedge fund with a five per cent stake in Yahoo led a shareholder’s revolt against Yahoo’s board and wanted to see documents related to Microsoft’s bid to buy the company.

Microsoft tried to take over Yahoo in 2008 with an offer of $31 a share, over double Yahoo’s share price now. According to Loeb, the documents will highlight the then Yahoo board’s “misjudgments and failures”.

Loeb is after documents that made up part of a shareholder lawsuit that was settled. According to Yahoo, its decision to cease efforts at keeping the documents sealed was due to the lawsuit being settled and unable to be reopened.

Loeb had tried to get his preferred board members onto Yahoo’s board or directors including himself, however the firm announced that it had appointed three new board members, none of which were on Loeb’s list.

AOL is trying to engineer a merger with Yahoo in order to lower costs.

AOL’s CEO Tom Armstrong reportedly has been working hard to generate support from shareholders for a deal with Yahoo. According to Reuters, Armstrong is presenting the deal as an alternative to going it alone as an internet media company in order to reap cost and advertising reach benefits.

Apparently Armstrong is claiming that a merger with Yahoo, which itself is at the centre of acquisition rumours, would bring in savings of between $1bn and $1.5bn by combining datacentres and consolidating content on areas such as news, sports, entertainment and finance.

Since AOL was spun out of its disastrous merger with Time Warner, the firm has been trying to remake itself into an internet media company by buying popular websites such as The Huffington Post and Techcrunch. While many question whether that is a workable plan, the financials can’t mask the deep trouble AOL is in, with the company reporting a $11.8m loss for the second quarter.

While talk of AOL being bought up has cooled considerably in the last few months, the firm still has a few worthwhile assets. According to Reuters’ sources, shareholders like the idea of merging with Yahoo but are not convinced that Armstrong can pull it off.

Just three years after a failed attempt to acquire Yahoo, Microsoft may be considering whether to give it another shot, Reuters reported today.

According to the report, Microsoft executives are split on whether the company should bid for Yahoo. A final decision has not been reached, the report noted.

Citing an unnamed “high-ranking Microsoft executive,” the report said Microsoft is evaluating whether to pull in a partner for a joint effort to buy Yahoo.

Microsoft said it doesn’t comment on rumors or speculation. Yahoo didn’t respond to a request for comment on the report.

“As long as Microsoft is committed to growing its online presence, this makes sense,” said Ezra Gottheil, an analyst with Technology Business Research. “Yahoo has a large number of subscribers and regular visitors, many of whom are not considering going elsewhere. And that would be a good boost for Microsoft.”

He also noted that Yahoo Mail, Yahoo’s popular free email service, would combine well with Microsoft’s own Hotmail service to create a very large base of email users.

In 2008, Microsoft tried to acquire Yahoo. Yahoo’s argument that the bid was tool low prompted Microsoft to finally give up.

Since then, Yahoo has been dealing with some significant problems.

No longer the high-flying Internet pioneer of its heyday, Yahoo last month fired Carol Bartz, who had joined the company as CEO with high hopes that she could return the company to its past glory.

Once Bartz was out the door, industry analysts began speculating that Yahoo’s board might be open to a solid acquisition offer.

Microsoft will debut next month a major overhaul of its Hotmail webmail service, with upgrades across the board, including in areas like spam, security and performance.

“We listened. We learned. We reinvented Hotmail from the ground up,” reads an invitation sent on Friday to journalists for press events to be held on Oct. 3 simultaneously in New York and San Francisco.

“Forget everything you thought you knew about Hotmail. Just don’t forget this date,” reads the invitation.

Hotmail’s primary competitors are Google’s Gmail and Yahoo Mail. The last time the consumer webmail market got a product jolt was in 2004, when Google surprised the world with Gmail and its then-unprecedented amount of email storage.

At that point, innovation in webmail services had stagnated for years but Gmail shook Microsoft, Yahoo and other webmail providers like AOL out of their comfort zone, as they quickly responded by increasing the size of their email inboxes.
